Doppeltätigkeit Das Verbot der Doppeltätigkeit nach § 2 Absatz 1 Buchstabe h Erste DVO ist mit Artikel 12 Abs. 1 Satz 1 des Grundgesetzes nicht vereinbar und deshalb nichtig (BVerwG, Urteile vom 2. März 1967, DÖV 1967, S.493; vom 25. Juni 1970, BVerwGE 26, S.254; vom 21. Januar 1993, BVerwGE 35, S. 308 DÖV 1993, S.568 und NJW 1993, S.2395).
